The Intellectual Property Department (IPD) is a scientific unit and is guided by the Constitution of Ukraine, laws of Ukraine, resolutions of the Verkhovna Rada of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, the Ministry of Education, Science, Youth and Sports of Ukraine, and other regulations. inventive activity.

The department carries out its activities in the general complex of educational, scientific and scientific-technical activities of the university and reports to the Vice-Rector for Research and International Relations.

The IPD cooperates with government agencies, Ukrainian and foreign innovation infrastructures, research institutions, organizations whose activities are related to the field of intellectual property and / or those who are interested in the creation and commercial use of intellectual property.

The main tasks of the department are:

• Organization and provision of modern management methods in the field of intellectual property.
• Ensuring the protection and lawful use of intellectual property that meet the needs of the domestic and world markets.
• Examination of the commercial potential of the results of scientific activity in order to determine the most promising objects and areas of commercial interest.
• Acquisition of intellectual property rights by the university, created as a result of its scientific, scientific-technical and educational activities, their promotion and transfer to the sphere of production.
• Creating an atmosphere of trust and cooperation based on the balance of interests of the university, its departments, employees, graduate students, students and potential commercial partners, establishing the business reputation of the university as a reliable and predictable partner.
• Information and analytical support of works on creation, protection and commercialization of intellectual property objects.
• Protection of the rights and legitimate interests of the university and its employees as creators of intellectual property in administrative and court proceedings, in particular, from unfair competition, illegal acquisition of rights to use intellectual property by third parties.
• Presentation of scientific and technical developments of the university, protected by patents of Ukraine, at exhibitions, competitions of various levels, as well as in advertising products.
• Involvement of university inventors to participate in the All-Ukrainian competition "Invention of the Year", held by the State Intellectual Property Service of Ukraine.

Carries out together with the relevant departments of the university analysis of research work planned for implementation, forecasting their results in order to determine patentable intellectual property that has commercial potential, the feasibility of their legal protection in Ukraine and abroad.

Prepares proposals for the classification of scientific, technical and other information with limited access, including confidential information, trade secrets.

Provides legal support for agreements to which the university is a party, in the part relating to legal relations in the field of intellectual property, including, provides clarification on the application of legislation, participates in negotiations and draft agreements on the formation of conditions, rights and obligations parties (legal protection, use of intellectual property, distribution of rights, ensuring confidentiality, payment of remuneration, costs and revenues, etc.), monitors their implementation.

Participates in the preparation and submission of documents (applications) for intellectual property in the statutory patent bodies in Ukraine and foreign countries in accordance with national and international procedures.

Participates in the preparation and provision of contracts provided by current legislation with the authors of the sale of intellectual property and monitors their implementation.

Takes measures to prevent the infringement of property rights in the use of intellectual property owned by the university and to prevent the infringement of similar rights of third parties.

Develops local normative and methodical documents of the university, regulating the creation, legal protection and use of intellectual property, financing of such activities, receipt and distribution of royalties and other income from the use of intellectual property, remuneration and other forms encouragement to inventors (authors) and persons who contributed to this activity; ensures the acceptance and monitoring of the implementation of these documents by structural units, employees, graduate students and students of the university.

Provides employees and students at the university, legal, informational and administrative assistance in the implementation of personal non-property and property rights to intellectual property belonging to them, and the benefits provided by applicable law and local regulations of the university, including the rights of employees-inventors (authors) to remuneration for the use of the sale of intellectual property created by them in connection with the performance of an employment contract or an order of the employer.

Carries out measures for the organization of training and advanced training in the field of intellectual property and commercialization of the sale of intellectual property of university employees, in particular, participates in the training of students and graduate students on these issues.

Maintains records and reports in the field of legal protection of intellectual property of the university.

Analyzes the state of scientific activity of the university and its separate divisions in the field of intellectual property, prepares proposals for its improvement, etc.

Together with the developers solves the issue of state registration of RW in UkrINTEI. Provides methodological and technical assistance in compiling registration, accounting and information cards on forms and electronic media, as well as reports and referrals to UkrINTEI.

Results of inventive activity

 

Inventive activity following the results of 2019-2020 academic year

The university pays great attention to the development of inventive activity, involvement in scientific and technical creativity of graduate students and student youth through their participation in research work. According to the State Enterprise "Ukrainian Institute of Intellectual Property" of the Ministry of Economic Development and Trade of Ukraine, the university confidently holds the first place among higher educational institutions of the Ministry of Education and Science of Ukraine in inventive activity.

During the 2019-2020 academic year, the university received 147 security documents. Of these, patents for inventions 41, including co-authored with students 22; utility model patents 102, including in co-authorship with students 76. The Ministry of Economic Development and Trade of Ukraine registered 4 certificates of copyright registration for the work.

On the occasion of the 135th anniversary of NUFT, an "Annotated list of security documents of university employees" was prepared and published. The collection contains materials of intellectual property in food, sugar, meat and dairy microbiological and other industries for which patents of Ukraine and certificates of registration of copyright to the work. The materials are systematized according to the sections of the International Patent Classification. The list is published in two volumes and covers the period from 1914 to 2019.

 

The University is an active participant in the All-Ukrainian competition "Invention of the Year". This year, a patent of Ukraine for the invention № 116733 "Method of obtaining rectified alcohol" was presented for the competition "Invention 2020". The author's composition includes Bulii Yu.V. - Associate Professor of Biotechnology of Fermentation Products and Winemaking, Shyian P.L. - Professor of the Department of Biotechnology of Fermentation Products and Winemaking, representatives of the production company LLC "TISER" Dmytruk A.P and Dmytruk P.A. The patent protects the resource- and energy-saving method developed at NUFT, the use of which provides a comprehensive solution to technological and environmental problems of alcohol production for the organization of waste-free production of fuel ethanol based on bioconversion of renewable plant raw materials. One of the co-authors of the patent is the Honored Inventor of Ukraine, Laureate of the State Prize of Ukraine in Science and Technology, Laureate of the Cabinet of Ministers of Ukraine, Doctor of Technical Sciences, Professor Petro Leonidovych Shyian - a consistent ideologue and tireless leader of the concept of intensive energy and resource saving fuel ethanol technologies. The claimed technical solution was for Shyian P.L. one of the latest promising developments. The patent was awarded a diploma of the Ukrainian Institute of Intellectual Property.
